SAKURA -JAPAN IN THE BOX- App
Terms of service
The Sakura - Japan In The Box - User Policy (hereafter, “this user policy”) applies to the licensing of the “Sakura - Japan In The Box” smartphone application (hereafter, “the app”) offered by Evixar Inc. (hereafter, “the company”) and related web content and the viewing (hereafter, “services”) of digital text and media (hereafter, “content”) in the app and related web content. A user must agree to this user policy in order to use the app and services. When a user installs the app, it is assumed that they agree to this user policy upon installation.
Article 1 (Scope of Application)
This user policy applies to the following:
・Sakura - Japan In The Box - smartphone app ("the app")
・Web content related to the app
・All services pertaining to the above
Article 2 (Required Operating Environment)
The app requires a connection with either the App Store or Google Play to be downloaded. The user is responsible for any data fees incurred. iOS 8.0 and higher or Android 4.1 and higher is also required.
Article 3 (Modification, Suspension, and Termination of The App And/or Services)
The company may modify, suspend, or terminate the app and/or services or delete content without prior user notification. In the event that a user sustains damages due to this, the company is not held responsible, regardless of the reason.
Article 4 (Use of Content)
The user may make use of the content in a legal manner during the period determined by the company.
Article 5 (Copyright)
1. The copyrights, trademarks, and any other intellectual property rights related to the app belong to the company or a legitimate proprietor who is entitled to the rights.
2. The copyrights, trademarks, and any other intellectual property rights related to the content belong to the company or a legitimate proprietor who is entitled to the rights.
Article 6 (Prohibited Matters)
The user is prohibited from doing any of the following activities on their own, or through a third party:
・Unlawful access to the company's software and communication equipment, computers, or other devices, actions that cause said unlawful access to occur, or actions that have may lead to said access
・In addition to the above, any actions that are illegal, actions that interfere with the service's operations, actions that damage the company's trust, actions that infringe upon the company's property, or any actions that inflict damage upon the company
Article 7 (Disclaimer)
1. The company does not make any guarantees of performance for the app, and is not responsible for any warranties against defects.
2. The company is not responsible for the integrity, authenticity, accuracy, or legitimacy for the information provided by the service.
3. The company does not guarantee that the service or contents do not infringe upon the intellectual property rights or other rights of a third party.
Article 8 (Changes to This User Policy)
1. The company may make changes to this user policy without prior user notification.
2. The company assumes that the user agrees with the user policy after releasing a changed version of this user policy through the app.
Article 9 (Governing Law)
This user policy is based on Japanese law, and will be interpreted based on Japanese law.
Article 10 (Exclusive Agreement Jurisdictional Court)
Any and all conflicts regarding this user policy will be handled by the First Exclusive Agreement Jurisdictional Court of the Tokyo District Court.
